NAR membership fight loses again in court as Tuccori settlements head to final approval
Original headline: “Final push for approval of Tuccori opt-in deals underway” — Real Estate News, Oct 9, 2026
Real Estate News reports the Third Circuit on October 7 affirmed dismissal of Muhammad, a suit claiming that requiring NAR membership for MLS access violates antitrust law; it was dismissed with prejudice and can't be refiled. Separately, NAR, Compass and Douglas Elliman filed briefs pushing for final approval of their opt-in settlements in the Tuccori buyer-commission case, with a fairness hearing set for November 2.
Our take (opinion & analysis, not reporting)
MLS access still runs through association membership, so budget your dues as usual, and watch the November hearing for how the commission settlements close out. For CRM and MLS budgeting, keep association dues in your fixed costs; nothing in this ruling removes them.
