CRMLS sues Compass first, asking a court to approve its private-listing rules
Original headline: “CRMLS sues Compass over MLS rules and public marketing” — HousingWire, Oct 6, 2026
California Regional MLS filed in federal court in New York on October 5, asking a judge to declare its cooperation rules lawful and to bar Compass from pursuing antitrust claims over them. The fight is over listings marketed to the public but kept off the MLS; Compass says agents shouldn't face fines for publicly marketing office exclusives and plans its own suit.
Our take (opinion & analysis, not reporting)
Until this is settled, check your own MLS's current rule before advertising any listing outside the MLS, because the fines are real today. If you market office exclusives, keep the seller's paperwork in your CRM or transaction file.

Agents and industry commentators on X describe this as a fight over how much listing transparency buyers keep. Greg Robertson put it as a question: what does cooperation mean when a few brokerages supply most MLS listings? Reffkin posted a 2018 CRMLS form to argue his side.
